Terms and Conditions of Online Sales

1. Scope of Application
These Terms & Conditions govern the contractual relationship between LuxuryDenim.com, operated by CMA JC UOMO SL, and any person (hereinafter “Customer”) purchasing products from the site.
These Terms apply exclusively to all purchases made via LuxuryDenim.com. By placing an order, the Customer fully accepts these Terms without reservation.
The site offers past-season Jacob Cohën collections available for delivery from Spain and Switzerland. All products and services shown are subject to availability. Images displayed are for illustrative purposes only and are non-binding.
2. Product Quality & Warranty
All items sold on LuxuryDenim.com are original, brand new, and carefully inspected. They come with tags and original labels. Items with removed labels cannot be returned.
Customers must inspect goods upon receipt. Any claim for damage, defect, or delivery error must be submitted within 10 days of delivery, or in the case of hidden defects, upon discovery — by email to: jacobcohen.marbella@gmail.com. After this period, goods are deemed accepted and no claims will be considered.
If the return is justified, we will proceed — at our discretion — with repair, replacement, or refund.
3. Account Registration
To place an order, the Customer must create a personal account with accurate and complete information. An email confirmation will follow registration.
The “My Account” section allows the Customer to update personal details and view order history.
4. Orders
Orders may only be placed by registered users. Once items are selected, added to the cart, and checkout is complete — including acceptance of the Terms, privacy policy, and return conditions — the Customer chooses a payment method and submits the order.
A confirmation email is sent immediately, but the order is considered final only once accepted by LuxuryDenim.com.
Orders cannot be modified or canceled online. Please contact customer service at jacobcohen.marbella@gmail.com for assistance.
Any commercial use of the site (e.g., resale to third parties) is strictly prohibited and may lead to account suspension or legal action.
5. Product Availability
Orders are shipped once all items are ready. While we strive for accurate inventory, some items may be unavailable at the time of shipping. In such cases, we will inform you promptly and refund the unavailable item(s).
6. Prices
All prices are in Euros (€) and include VAT. Prices may differ between the online shop and physical stores due to exclusive promotions.
The applicable price is the one displayed at the time of the order confirmation. Shipping within the EU is free unless stated otherwise.
7. Accepted Payment Methods
We accept the following secure payment methods:
• Visa
• MasterCard
• American Express
• iDEAL
• Apple Pay
8. Secure Payment & Transactions
All transactions are processed through secure, encrypted systems (HTTPS). Payments are handled by Stripe, our trusted payment provider. We do not store any credit card information.
Cards are charged only upon shipment of the order, after verification and approval by your issuing bank.
9. Delivery
Deliveries are made via DHL Express:
• EU: Free shipping and returns.
• Rest of the World: €25 shipping fee.
We deliver DDP (Delivery Duties Paid) — meaning all customs and taxes are covered by us.
EU deliveries typically arrive within 2 working days.
Claims for compensation due to delayed delivery are excluded.
10. Returns
You may return any unworn item within 10 days of receiving your order.
• Returns within the EU are free via DHL Express using the provided prepaid label.
• For returns outside the EU, return shipping is at the Customer’s expense unless otherwise arranged.
Returned items must be:
• New, unworn, unwashed.
• In original condition, with all labels and packaging intact.
• Packed in the original box or DHL envelope (if possible).
Returns must be requested in advance via jacobcohen.marbella@gmail.com, including your order number and the item(s) you wish to return.
Returns are also accepted in-store with the original invoice.
11. Refunds
If all return conditions are met, refunds will be issued via the original payment method. Refunds are not issued in-store.
12. Retention of Title
Products remain the property of LuxuryDenim.com until full payment is received. In case of non-payment, goods may be reclaimed.
13. Product Authenticity
We guarantee the authenticity and premium quality of all items sold. All products are sourced from certified workshops and crafted to the highest standards.
14. Visual Differences
Due to screen variations and photography, minor differences may occur between the product image and the actual item. These are not considered defects.
15. Personal Data Protection
We respect your privacy. Personal data is used solely for order processing and customer service. It is never sold or shared, except with trusted logistics and payment providers who require it to fulfill your order.
You can access, modify, or delete your personal data at any time from your My Account section.
We also use cookies to enhance your shopping experience and Google Analytics for anonymous traffic analysis.
16. Amendments
LuxuryDenim.com reserves the right to modify these Terms at any time. The applicable version is the one published on the site at the time of order.
17. Governing Law & Jurisdiction
These Terms are governed by Spanish law. Any dispute shall be brought before the competent court of the Customer’s place of residence, or the courts of Málaga if the Customer initiates proceedings.
